TERMS:
Delivery: PYC agrees to deliver at Bellingham the Vessel designated above in full commission and in proper working order, inclusive of that required by law; clean and in good condition throughout and ready for service. PYC agrees to allow a reduction fee pro-rated to the Charterer for any delay in delivery beyond 6 hours. PYC reserves the right, for an aggregate total of 24 hours for each six days of charter, for correction of any problems with Vessel, without compensation to Charterer. Thereafter PYC will allow a pro-rata, at its discretion, for lost cruising time. Charterer taking over Vessel and leaving Bellingham with it certifies full acceptance of the Vessel, its condition, its equipment, and supplies, and signifies full performance by PYC of its obligations to Charterer. Should the Charterer not accept delivery of the Vessel for whatever reason at the specified time and place above, PYC will hold the vessel for the Charterer for the length of the Charter period, but only if the full fee has been paid. Should Charterer wish to cancel charter, a refund will be given, provided PYC receives written notice of cancellation 60 days prior to scheduled departure date of charter. A $150 service fee will be deducted from the reservation deposit. Charter cancellations 22-59 days prior to scheduled departure date will forfeit the reservation deposit: 21 days or less will forfeit entire charter fee. Should it be impossible for PYC to make delivery as stipulated, through causes beyond its control and should such delivery not be made within 24 hours thereafter, then this contract may be cancelled by either party and, in that event, all charter fees paid in advance will be returned to Charterer in full, and all responsibilities of either party to the other would be cancelled. Insurance: The Vessel chartered is insured against fire, marine, and collision risks by a standard marine hull and machinery insurance policy obtained by the Vessel’s owner owner and supplemented with operator liability fees. This insurance, subject to an applicable deductible, by its terms, shall insure against loss due to risk enumerated in the policy occurring while the Vessel is in the possession of, and operated by, Charterer. A copy of the insurance policy is available for inspection at the offices of PYC. Charterer shall be responsible for any loss or damage not covered by insurance resulting from operation of the Vessel in breach of this contract or applicable insurance policy. Charterer agrees to hold PYC and the Vessel’s owner harmless from any and all liability for injury or damage to any person or property arising out of Charterer’s use of this Vessel not covered by insurance. In the event of any occurrence which may result in loss, damage or expense for which any insurer may become liable, including damage to the Vessel or other property and injury to any person arising out of use of the Vessel, Charterer shall give prompt notice of such loss, injury or break down to the insurer and PYC. Charterer shall not attempt repair to the Vessel without authorization of PYC. Charterer may, however, complete any necessary repairs costing not more than $100.00 without authorization of PYC and PYC may reimburse Charterer for such expenditures if, in its discretion, PYC determines that such repairs were not necessitated by any fault of Charterer. All claims for reimbursement shall be supported with receipts from recognized marine repairers and suppliers.
Running Expenses: PYC will have stove, engine fuel and water tanks full at the start of the charter. The Charterer agrees to pay all running expenses after commencement and during the term of the charter including (but not limited to) ice, fuel, oil, propane, food, and other consumable goods, pilotage, port charges, fines, customs charged, and provisions for himself and party, unless these have been ordered and paid for through agreement with PYC. At the conclusion of the charter the Charterer agrees to replenish all consumables used during the charter at his expense except those previously paid for. In the event PYC has to refuel boat, a fee of $100.00 will be charged in addition to the cost of the fuel.
Redelivery: Charterer agrees to surrender the Vessel between 8:00-12:00pm at PYC docks in Bellingham, free and clear of any indebtedness and liens whatsoever, and having properly cleared U.S. customs. Charterer is responsible for allowing sufficient time for fueling, watering, and unforeseen contingencies to permit his return at the stated time. Penalties are charged for late return without prior authorization. Should Charterer not make redelivery of the Vessel at the time hereinbefore stipulated for any cause, he shall pay $50.00 per hour for the first 24 hours of delay. Additional delay will be charged at double the daily rate plus any costs and losses that PYC or the Vessel owner may sustain due to delayed delivery.
Substitution: If for any reason the reserved Vessel is not available, PYC will do it’s best to find a substitute vessel of the same size and amenities subject to the approval of the charter guest. Should charter guest choose not to accept replacement vessel, charter guest agrees to refund of paid charter fees to date without further compensation.
Restricted Use: Charterer agrees that the Vessel shall be employed exclusively as a pleasure Vessel for the sole and proper use of himself and stated party and shall not be used to transport merchandise or carry passengers for hire or pay; race, or engage in any trade; not in any way violate the laws of the United States or any other government within the jurisdiction of which the Vessel may be at any time during the term of the charter. Charterer agrees to restrict the cruising area of the Vessel to the waters East of Cape Flattery (longitude 124 degrees 40 minutes West) and South of Malcolm Island, and the insurance will not apply if the Vessel is sailed or underway after sunset or before sunrise; when visibility is restricted; in gale force or higher winds; or if charterer fails to abide by any PYC cruising area instructions. In these events Charterer is fully and completely liable for any damages sustain to the Vessel or its occupants unless it can be established that such action was necessary through emergency circumstances not created by Charterer, The Charterer agrees not to assign this contract or subcharter the Vessel without the consent of PYC in writing, and agrees that no smoking/pets/or animals are allowed in Vessel unless prior arrangements are made.
